What is the EB-3 visa?

How long does the PERM Labor Certification usually take?

The Perm Labor Certification is usually the first big step, and it can be a bit of a waiting game. Generally, you’re looking at anywhere from 6 to 18 months, but it can even stretch longer. A lot depends on how quickly the Department of Labor processes applications and if there are any audits or issues with the employer’s recruitment efforts.

Once PERM is approved, how long before I can file Form I-140 (Immigrant Petition for Alien Worker)?

As soon as that PERM is certified, your employer can usually file the I-140 pretty quickly if they opt for regular processing, which can take around 6 to 9 months. But, if they use premium processing, you might get a decision in as little as 15 calendar days! Of course, premium processing comes with an extra fee.

What’s the deal with priority dates and the Visa Bulletin? How long do I generally “wait” for my priority date to become current?

The priority date is a big one! Your priority date is usually the date your PERM application was filed. The Visa Bulletin, published monthly by the Department of State, determines when you can apply for your green card. The wait time for your priority date to become current can vary wildly depending on your country of birth and the specific EB-3 category. For some countries, it could be a few months to a couple of years, while for others, especially those with high demand like China or India, it could be many years, even a decade or more. It’s the most significant variable in the whole process!

Once my priority date is current, how long does it take to process Form I-485 (Application to Register Permanent Residence or Adjust Status)?

This is the final stretch if you’re already in the U.S.! Once your priority date is current and you’ve filed your I-485, the processing time can typically range from 8 months to 2 years, or sometimes even longer. It depends on the USCIS service center, if you have an interview, and if there are any requests for additional evidence.

So, what’s a realistic overall timeline from start to finish for the EB-3 process?

Putting it all together, it’s pretty tough to give a single, definitive answer because of all those variables, especially the priority date wait. However, for a general idea, if you’re lucky enough not to have a long priority date backlog for your country, you might be looking at 2 to 4 years from PERM filing to green card in hand. But, if you’re from a country with a significant backlog, the process could easily stretch to 5 years, 10 years, or even longer.

Can I change jobs during the EB-3 process?

Generally, it’s risky and can mess up your timeline.

  • Before I-140 is approved: You’ll likely have to restart the whole process with your new employer, meaning a fresh PERM and a new, later priority date.
  • After I-140 is approved AND I-485 has been pending for 180+ days: You might be able to switch employers without losing your place in line (your priority date), but the new job needs to be similar to the old one. You’ll still need legal advice to do it right.
